TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By accessing and using the LVR website, mobile application, and all related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. LVR reserves the right to modify these Terms at any time. Your continued use of the Service following any modification constitutes your acceptance of the modified Terms.

2. USE LICENSE

2.1 Grant of License

LVR grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for the lawful purpose of browsing and purchasing merchandise. This license does not permit you to: (a) sell, modify, or distribute the Service; (b) reverse-engineer, decompile, or disassemble any portion of the Service; (c) use automated systems or bots to access or extract data; (d) remove or alter any proprietary notices; (e) use the Service for any unlawful purpose.

2.2 Restrictions

You may not use the Service to transmit viruses, malware, or any code intended to disrupt operations. You may not engage in any activity that interferes with or disrupts the Service, servers, or networks connected to the Service. LVR reserves the right to terminate access for any violation of these restrictions.

3. USER ACCOUNTS

3.1 Account Responsibility

If you create an account with LVR, you are responsible for maintaining the confidentiality of your account credentials and password. You agree to:

(a) Provide accurate, current, and complete information

(b) Immediately notify LVR of any unauthorized access to your account

3.2 Account Termination

LVR reserves the right to suspend or terminate any account at any time for violation of these Terms or for any other reason at LVR's sole discretion. Termination does not relieve you of payment obligations for purchases made prior to termination.

4. PRODUCT INFORMATION AND PRICING

4.1 Product Accuracy

LVR makes every effort to display accurate product descriptions, images, and specifications. However, we do not warrant that product descriptions, pricing, images, or other content on the Service are accurate, complete, or error-free. Color variations may occur due to monitor or device settings.

4.2 Pricing

All prices are in USD unless otherwise stated. Prices are subject to change without notice. LVR reserves the right to limit quantities and refuse orders. If an item is listed at an incorrect price due to technical error, LVR may cancel the order or correct the price and request authorization before processing payment.

4.3 Availability

Products are available while supplies last. LVR makes no guarantee regarding the availability of any item. Limited drops may sell out without notice. Once an item is marked as sold out, it will not be restocked unless explicitly announced.

5. ORDERS AND PAYMENT

5.1 Order Placement

By placing an order, you represent and warrant that you are at least eighteen (18) years old and have the legal authority to enter into binding agreements. You further represent that all information provided (name, address, payment details, etc.) is accurate and belongs to you.

5.2 Acceptance of Orders

Placing an order does not constitute acceptance by LVR. LVR reserves the right to accept or reject any order for any reason, including verification of payment information, suspected fraud, or inventory issues. You will be notified via email if your order is rejected.

5.3 Payment

Payment must be made in full at the time of purchase. LVR accepts major credit cards, debit cards, and other payment methods as displayed on the Service. You authorize LVR to charge your payment method for the full order amount, including taxes and shipping fees. If payment is declined, your order will not be processed.

5.4 Taxes and Shipping

You are responsible for all applicable taxes on your purchase. Shipping costs are calculated and displayed before checkout. Shipping times are estimates only and LVR is not liable for delays caused by carriers or external circumstances.

6. SHIPPING AND DELIVERY

6.1 Shipping Policy

LVR ships orders to addresses within the United States. International shipping is not currently available. Shipping dates and estimated delivery windows are provided at checkout but are not guaranteed. LVR is not responsible for delays caused by carriers, weather, customs, or other external factors.

6.2 Risk of Loss

Risk of loss transfers to you upon delivery to the carrier. Once your order is shipped, you assume all risk of loss, damage, or delay. LVR recommends requesting signature confirmation for high-value orders.

6.3 Lost or Damaged Shipments

If your shipment is lost or damaged in transit, you must report the issue to LVR within forty-eight (48) hours of the estimated delivery date with photographic evidence. LVR will work with the carrier to file a claim and will replace or refund your order at its discretion.

7. INTELLECTUAL PROPERTY

7.1 Ownership

All content on the Service, including text, graphics, logos, images, designs, and merchandise, is the exclusive property of LVR or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or transmit any content without prior written permission from LVR.

7.2 Trademarks

"LVR" and all associated logos and designs are trademarks of LVR. All other trademarks, logos, and brand names are the property of their respective owners. You may not use any LVR trademark without prior written consent.

8. USER-GENERATED CONTENT

8.1 License Grant

By submitting any content to the Service (including comments, reviews, photos, or messages), you grant LVR a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, and distribute such content in any medium. You represent and warrant that you own or have the right to grant this license.

8.2 Content Standards

You agree not to submit content that:

(a) Is illegal, defamatory, harassing, abusive, or discriminatory

(b) Violates anyone's privacy or intellectual property rights

(d) Impersonates any person or entity

8.3 Moderation

LVR reserves the right to edit, remove, or refuse to publish any user-generated content that violates these Terms. LVR does not pre-screen content but may remove content at any time at its sole discretion.

9. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, LVR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, EVEN IF LVR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

LVR'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THIS AGREEMENT SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

10. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS-IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. LVR DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LVR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

SOME JURISDICTIONS DO NOT ALLOW DISCLAIMER OF WARRANTIES, SO THESE DISCLAIMERS MAY NOT APPLY TO YOU.

11. INDEMNIFICATION

You agree to indemnify and hold harmless LVR, its officers, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your infringement of any third-party rights; or (d) your user-generated content. This indemnity applies regardless of whether LVR is aware of the potential liability.

12. PRIVACY

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of personal information as described in the Privacy Policy.

13. PROHIBITED CONDUCT

You agree not to:

(a) Resell merchandise without authorization

(b) Use bots or automated systems to purchase limited-edition items

(d) Harass, threaten, or abuse other users or LVR staff

(e) Attempt to bypass payment or security systems

(f) Violate any applicable laws or regulations

14. THIRD-PARTY LINKS

The Service may contain links to third-party websites and services. LVR is not responsible for the content, accuracy, or practices of third-party sites. Your use of third-party sites is subject to their terms and policies. LVR does not endorse or warrant any third-party content.

15. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in New York County for any disputes arising from these Terms or your use of the Service.

16. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.

17. ENTIRE AGREEMENT

These Terms, along with the Return and Refund Policy and Privacy Policy, constitute the entire agreement between you and LVR regarding your use of the Service and supersede all prior or contemporaneous agreements, whether written or oral.
